We just misplaced(possiby for good)the car keys-we have spare set but how do we secure car just in case?
Do we really have to go to the expense of changing locks etc? Is there another less expensive way to keep the car secure just in case someone has found the keys outside next to the car?
We had been bringing in the shopping then my hubby decided to try to help a wee woman struggling to walk up the road..by the time he came in %26amp; we busied about for a bit then we realised %26quot;where are the car keys%26quot;
Chances are they ARE somewhere in the house but we have looked everywhere we have thought of, the chest freezer, the bin, the washing basket among all the usual places.

Almost three years ago, I broke my lease and left my apt. I came back a couple of months later to retrieve my stuff, only to find my apt cleaned out. I went and asked my ex about it(he lived in the building and got my key(they were changing locks during my absence), %26amp; he admitted that he let his sis hang up there(she's done this b4), %26amp; I guess this time she stole a lot of my things. Then I was told that since my stuff was stolen, the remaining debt I had with the complex wouldnt have to be paid. Since my stuff was still on their property when it was stolen.
But they're still after the debt. My parents and I assessed the value of stuff taken from my place, and the value of everything exceeds the debt they want paid, and we notified them in writing. They didn't want ot speak to us. Plus, I'm glad my ex had the key...otherwise we wouldnt've been able to get into my place at all! The maintenance man was NOWHERE to be found! Plus, I got a notice from them telling me to clean out my apartment, or loose all my stuff. Mom says I should just write another letter to them, but I'm gonna get bothered again for a debt I don't owe. what should I do to remedy this? It's a matter of principle. Any help would be appreciated, thanks. B nice! Please.

Just because you broke the lease doesn't mean that you did not pay in full for the time your items remained in the apartment. C'mon posters, lets think here. Most lease breaks require a 60 day notice, so if her stuff sat there for two months that time period had already been paid for anyway.
Renter's insurance (required by most complexes) should have covered the stolen items.
You say you were told that you wouldn't have to pay since your items were on their property, but who told you that? A representative of the complex or just someone you know?
If the debt is over 3 years old then it is already on your credit report as a negative entry (check to be sure) if this is the case, then do not pay it. Check the statute of limitations for legal collection in your state. If it isn't a very large amount, most collection agencies won't bother.
If you pay the debt after it has landed on your credit report and sat there for 3 years you not only restart the statute of limitations you reset the reporting period. Meaning, instead of having another 4 years to go until it falls off your report you have another 7 years. Plus, if you pay it, that does not improve your credit.
If you have written proof that you were absolved of the debt, nail them for all you have and force them to correct your credit report in lieu of a lawsuit. Otherwise, leave well enough alone and lay low until the SoL runs out for your state. Then hit them with a cease and desist letter stating they cannot in any way contact you. After that they cannot contact you and they cannot sue you.
And did you go to the police, file a report, have the girl questioned, arrested, anything? Just curious.
Make sure to get everything in writing from now on.

The only way to rid yourself of the debt completely would be if you had evidence to the fact that they said you would not have to pay the debt as it was stolen on their property. You have your word, but would need further proof of this to dispute it and succeed. If you do have such proof however, they should accept it.
I do strongly advise against debt dodging, if you have no documentation to prove they claimed this, then as far as the court is concerned, it was never said.

The matter of principle is to follow the lease. Was a police report filed for the stolen stuff? Since your ex gave the key to his sister and let her stay there, was she paying the rent? Did you get the agreement about not having to pay the remainder of the lease in writing? If not sorry you are probably out of luck and will be held liable. More than likely the person who told you that you didn't have to pay is long gone, and know the replacement is proceeding to collect the debt as per the lease. Looks to me like the ex and his sister should be liable for the missing stuff not the apt. management. You gave your key to your ex so unless the Complex Management had %26quot;control%26quot; of your processions, and were holding your stuff until you payed your rent they can't be held liable for what happened.

We rent home that is going to foreclosure (or alredy in the process).We received notice on our door saing that home is on foreclosure and we probably need to look for anover place.It was shock for us because our landlord said before that everything is Ok with this home.We tried to rich her but she never answered to our calls.After few week a person came to our home and asked who is living wrote somethig in his papers and left.We didn't payed for rent and finaly she called us.My husband explaned her that we don't know whom we need to pay,because we know that she is not paying her mortgage and didn't paied taxes for this home for last 2 years(we checked it at public records)

If you don't pay in 3 days from the delivery of the notice, the landlord can choose to go through the eviction proceedings. This will take some time. Go to this web address http://www.rentlaw.com/statelist.htm and click on your state to get your landlord tenant law. This will give you an idea of how long the eviction process takes.
This being said, your landlord has the right to evict you even though the home is in forclosure. In my opinion you should pay the rent. Not doing so could result in eviction and that would really screw up your chances of renting elsewhere. It could make life miserable for you for years to come. You could take a chance on the eviction court judge ruling in your favor, but that's risky. Find legal aid in your community. Most large cities have tenant associations that give free legal assistance. Give written notice to your landlord that you'll be moving. Make sure the time frame complies with your state law. Tenant has now moved and handed possession back over to me the owner. She refuses to return the key for she wants to come and get her belongings out. She has now been gone for 40 days. How much longer do I have to hold her belongings, I am ready to clean out the home and put it up for sale. Should I send her notice. I can't allow her back into the home I am changing locks today.

since she legally claimed to have abandoned it then collect her belonging, put in storage charge her fees for storage and do not release the belongings until she has paid for that plus back rent. CHANGE THE LOCKS IMMEDIATELY! she legally declared she abadoned it so she has no right to enter the property keys or no keys.
You need to look up landlord/tenant rights for your state.
They'll all have similar, but slightly different, rules about how long you must retain her property, how much you can charge her for storing it during that time, etc...
Find the laws and get it right.
If the tenant still has the keys she still has possession of the unit. Rent is still due and payable for the 40 days. Bill her for it and advise her that if she does not pay that you will start formal eviction proceedings. Remind her that rent continues to accrue until she has handed the keys back.
Since she has apparently been out of the property for over 30 days with rent unpaid you may well be able to consider the property as abandoned by the tenant. In that case you probably do not need to proceed with a formal eviction.
You should then send her notice of the fact that you are treating the premises and any personal property as abandoned and that you will dispose of any personal property remaining in the property as you see fit if it is not removed within 10 days. Send it certified mail, return receipt requested. If she hasn't removed her property when the 10 days has elapsed, put it in a commercial storage locker under her name and pay for the first 30 days and send her the address of the facility and the key to the locker. Then change the locks on the house and carry on with your sale.
After all that, I'd bill the tenant for the lock changes plus full rent up until I changed the locks. I'd also follow through with a Small Claims Court case for collection on that if she doesn't pay up.

I assume you got first and last with the cleaning deposit. Tell her that the cleaning deposit will be used to pay for having her belongings hauled to the dump.
As you are doing all this, file a claim in small claims court for the unpaid rent. Never rent without keeping a set of keys to your property. When your renter abandoned the property and her personal property, she gave up any renter's right she may have had.
Storing the items the tenant left behind?
as long as the tenant has the keys, you do not have possession of the unit. they do. which means charge them rent. its the law.
since she legally claimed to have abandoned it then collect her belonging, put in storage charge her fees for storage and do not release the belongings until she has paid for that plus back rent. CHANGE THE LOCKS IMMEDIATELY! she legally declared she abadoned it so she has no right to enter the property keys or no keys.
You need to look up landlord/tenant rights for your state.
They'll all have similar, but slightly different, rules about how long you must retain her property, how much you can charge her for storing it during that time, etc...
Find the laws and get it right.
If the tenant still has the keys she still has possession of the unit. Rent is still due and payable for the 40 days. Bill her for it and advise her that if she does not pay that you will start formal eviction proceedings. Remind her that rent continues to accrue until she has handed the keys back.
Since she has apparently been out of the property for over 30 days with rent unpaid you may well be able to consider the property as abandoned by the tenant. In that case you probably do not need to proceed with a formal eviction.
You should then send her notice of the fact that you are treating the premises and any personal property as abandoned and that you will dispose of any personal property remaining in the property as you see fit if it is not removed within 10 days. Send it certified mail, return receipt requested. If she hasn't removed her property when the 10 days has elapsed, put it in a commercial storage locker under her name and pay for the first 30 days and send her the address of the facility and the key to the locker. Then change the locks on the house and carry on with your sale.
After all that, I'd bill the tenant for the lock changes plus full rent up until I changed the locks. I'd also follow through with a Small Claims Court case for collection on that if she doesn't pay up.

homeowner had house up for sale prior to court .owed other party money, when asked how was going to pay debt owner offered that they can take a lien and put it in her escrow so when the house was sold they would get money directly from her escrow that way she showed she had means and wasnt gonna get her money and run she would pay her debts from her sale proceedes.but instead other party stop the sale of her home changed locks so realtor had no acess and put their onw lien on it. wanted to fight that right there,but instead due to time asked date of lien sale auction and total amount.they told her 10th of month . emails to prove this. so on 7th of month got a loan from family member to have debt cleared and remove from auction. talked to lawyers of other party and was told where to pay when then another email came saying it would do no good as auction was the 6th. they told her 10th. finding out same day on 7th it did not sell. no one bid on it.they have ignored her ,house sits abandon
