As a decades long commercial landlord in California, the legal process for evicting a commercial tenant is identical to evicting a tenant living in a residence.



First, the 3 Day Notice, either to Pay Rent or Quit or to Perform Covenant or Quit.



Then they must serve the tenant with a Summons/Unlawful Detainer Complaint. You have five days to respond back to the court after being served. If you do not respond in writing the Plaintiff/Landlord will get a default judgment and you will be evicted.



If you answer the complaint then a hearing is scheduled, usually within 2-3 weeks and both the tenant and landlord plead their case and the judge makes a decision.



A landlord can NEVER remove a tenant without giving the tenant %26quot;due process%26quot; and without a court order. The landlord must also use the Sheriff to physically remove the tenant. With a court ordered Notice of Possession the Sheriff comes to the property and does a %26quot;lock out%26quot; where the locks are changed and the Sheriff turns over possession of the property to the landlord.
