Landlord changed locks, and removed personal property while I was away on vacation is this legal?

I had a rent dispute with my landlord over work I performed for him that was suppose to be applied to my rent. I went out of town over the Independence weekend. Apparently, my neighbor told the landlord I was going to be gone for the weekend. I returned Monday evening to find the locks changed. Since I have occasionally locked myself out of the house I climbed through my patio window to gain access to the unit. To my surprise, I found almost half of my possessions gone. The landlord then apparently called the police and told them I broke into the apartment. The police made him give me keys to the apt, and told him that if he wanted to evict me he had to go through the courts. Well, I was served later in the week with an eviction notice.



In the eviction notice he states that I was three months behind in my rent. Not correct. I paid cash for the rent, and had receipts. But now they are gone, he took them when he stole my stuff. I have subpoenaed the neighbor to show up in court (he knows the landlord illegally changed the locks, and took my stuff), but how am I going to prove that my rent was paid, and how am I going to get my stuff back?

Call the police, and report a burglary. Have them interview the neighbor, who can tell them who took your property.

I hope your reported to the police when you found your belongings gone so you can at least get a report. You are going to have to contact your local housing authority for real answers.
He absolutely does not have the right to change the locks or remove your belongings while you are still a resident in the apartment. He absolutely does not have the right to keep your belongings. You would have a cause of action against him for that.



However, it's really going to be hard to prove that he stole your receipts.
