After someone moves out how long do you have to wait to change the locks?

my dad moved out and my mom would like to change the locks. they are currently still married - how long does she legally have to wait to do so.

Depending on states. I have heard in the state of GA you have to wait 30 days. If they have established residency and have bills coming to that house with their names on it they have 30 days to collect all of their stuff when moving out.



It seems though if the house is in her name only then she should be able to change the locks at any time. She will however have to allow him time to pick up his stuff and not deny him of entering to get his stuff.

if owns the property - that is her call - especially if concerned about safety
No legality involved here. She can change the locks immediately. If he still has belongings there, she will have to allow him to make arrangements to pick them up, but she doesn't have to leave the doors open to him!
As soon as he's gone. If he moved out, he doesn't need to have a key.

She can change the locks. To be honest it is never illegal to do anything that she feels will insure her safety. **** the law do what you need to do. Take care of your mom and tell her to take care of herself. It's not a nice world we live in. Gotta take responsibility in your own hands and growup. The law is not omnipitant.
As a courtesy she should wait until he gets all of his things. But it is actually her right to change the locks at any time. I would go ahead and change them especially if she is afraid of him taking her things or trying to hurt her. Good Luck!

my mom changed the locks about 10 months before her divorce was finalized. i remember that it was july 4th; we celebrated our independence from him ALL NIGHT LONG!

change them; the worst that can happen is he files some legal thing to make you give him a key...i doubt that will happen.
this is not from a legal stand point. Your dad should have returned the keys when he moved out. Your mom should be asking for the keys - giving him a day to return them - if he doesn't, by all means she should change the locks.
If his name is still on the deed of the house I believe it is until it is removed - unless there is a restraining order against him.

No waiting required. Have a locksmith come out and change all the locks whereas one key fits all. That really makes life much easier than having many keys. If you have an automatic garage door opener, change that code as well.
If he has title to the property then that would be up to the courts unless there is a restaining order. Otherwise-only as long as it takes for the locksmith to get there.
Well he was the one who left. I would change them NOW. It's her right to be safe...
if your father moved out but is stil, paying the taxes and has the deed to the home, he can legally throw her out bagagge and all. it dosent materr if there married or shacking up or what. now if dear mother has the home pays the upkeep, taxes deed, and they are going threw judge judys court room(divorce) the minute he has, moved out all of his stuff and hit the ghighways she can legally change the locks anytime she sees fiit providing she owns said home. there is a 30 day, cooling off period but if he even has a pencil of his she can not change the locks etc.

After the divorce is final. The house is considered community property as long as they're married. This means the house at this time belongs to your mam and your dad.
